Abstrak
Technological developments offer convenience and speed in many areas of human life. including buying and selling transaction activities. Buying and selling transactions in this modern era can be carried out more easily and quickly through e-commerce platform services. Shopee is one of the largest online buying and selling service providers in Indonesia. In order to expand the reach of its market share, Shopee is pursuing a marketing strategy through the Shopee affiliate program. Through this program, Shopee offers commissions to affiliates who successfully offer products sold on Shopee services until they are sold. The Shopee affiliate program is a new form of economic activity that has never been studied specifically in the Islamic jurisprudence literature. Human economic activity is one line of human life that must comply with the rules of Islamic law. In the Islamic jurisprudence, the various types of contracts recognized in Islamic law have been described in full along with their regulations. Of the many contracts, there are two contracts that are relevant to be used as a tool to test the conformity of the Shopee affiliate program with Islamic law, namely the samsarah and ju`alah contracts. From the two contracts above, the author considers that the ju`alah contract is more relevant as a measuring tool for assessing the suitability of the Shopee affiliate program with the rules of Islamic law. This research is library research, where the author examines library data in the form of Shopee affiliate program regulations using the ju`alah contract theory in the cross-school jurisprudence literature as a tool for analysis.
