TINJAUAN HUKUM ISLAM TERHADAP PRAKTIK GADAI SAWAH DAN BAGI HASIL PANEN DI DESA NGUJUNG KECAMATAN MALO KABUPATEN BOJONEGORO

Abstrak

Fiqh as a field of scientific study discusses all human behavior, including economic activity. Economic activity is experiencing rapid change and development. This development must be responded to quickly and precisely through the study of muamalah fiqh in order to find out the law. Many of these changes are caused by technological developments, changes in people's lifestyles, and shifts in people's thinking patterns. Among the developments in economic activity are the practices of pawning rice fields and sharing harvests which are often found in Ngujung Village, Malo District, Bojonegoro Regency. In this article, we discuss the practice of pawning rice fields and sharing the harvest. This practice is analyzed using the theory of legal contracts in Islamic law. The aim of this research is to determine the appropriate law for the practices found and to find appropriate alternative contracts in Islamic law.
