Abstract
This article presents a comparative study of Qawa'id Fiqhiyyah across various Islamic jurisprudential schools, aiming to analyze the similarities and differences in the legal maxims recognized by each school. It highlights the significance of these principles as foundational elements in Islamic law, providing a framework for addressing contemporary legal issues that lack explicit textual evidence from the Qur'an or Sunnah. The study emphasizes the definitions of Qawa'id Fiqhiyyah as articulated by prominent scholars, illustrating their general applicability in diverse legal contexts. Furthermore, it explores the implementation of these maxims within the Hanafi, Maliki, Shafi'i, and Hanbali schools, showcasing how each school approaches legal rulings and the underlying objectives of their jurisprudence. Ultimately, this comparative analysis aims to enhance understanding of the dynamic nature of Islamic law and its adaptability to various societal contexts.
