Abstrak
An annulment of a marriage is the act of a court decision stating that the marriage carried out is invalid, as a result of which the marriage is deemed to have never existed. Among the annulments of marriages carried out by the Gresik Religious Court is the decision in case Number 1633/Pdt.G/2022/PA.Gresik. The case was filed by the Panceng District KUA who sued the marriage which had been registered at the KUA. Apart from this, it was also discovered that the first and second wives were related, namely that the status of the second wife was the sibling of the first wife. The basis used by the Panel of Judges in deciding case number. 1633/Pdt.G/2016/PA.Gresik concerning annulment of marriage, namely a marriage carried out by two parties, namely a polygamous marriage without the wife's permission, which violates the provisions of the Law, articles 57, 58 KHI, article 5 Law no. 1974 concerning Marriage, article 85 of the Civil Code and violating the rules of Islamic law as stated by Allah SWT, QS. An-Nisa' verse 23 is the prohibition on a man bringing together two women who are siblings in a marriage, which also violates the provisions of Article 70 of the KHI, Article 8 of Law no. 1974 concerning Marriage, articles 30, 31, 32, 33 of the Civil Code.
